After decades of organizing by incarcerated people and their communities, the Pennsylvania Supreme Court unanimously ruled last week that mandatory Death By Incarceration for felony murder is unconstitutional. As of Thursday morning, almost 1,100 people are currently serving unconstitutional sentences in PA state prisons.

This victory has the potential to undo the most DBI sentences since 2012, when the U.S. Supreme Court (in Miller v. Alabama) struck down mandatory life without parole for children, giving the chance for parole to 2,500 people nationwide. But it is not a given. Lawmakers could choose to pass legislation with egregious mandatory minimums or write laws that only apply to future cases without accounting for those already sentenced to DBI for felony murder.

For the next four months, we will need everyone who cares about justice for incarcerated people to pressure PA lawmakers to pass legislation that allows the most people to come home as quickly as possible.
